President Boakai Declares Tuesday August 12, 2025, A National Holiday Only in Electoral District #5, Nimba County to Hold the By-Election

The President of the Republic of Liberia, His Excellency President Joseph Nyuma Boakai, Sr., has by Proclamation declared Tuesday August 12, 2025, as By-Election Day, and is to be observed as a National Holiday only in Electoral District #5, Nimba County.

 According to a Foreign Ministry release, one vacancy was created in the Legislature, precisely in the Honorable House of Representatives as a result of the election of Honorable Samuel G. Kogar.

The Proclamation is in consonance with Article 37 of the Liberian Constitution which provides that, in the event of a vacancy in the legislature caused by death, resignation, expulsion or otherwise, the presiding officer shall within 30 days notify the Elections Commission thereof. The Elections Commission Shall not later than 90 days thereafter cause a by-election to be held; provided that such vacancy occurs within 90 days prior to the holding of the general elections, the filling of the vacancy shall await the holding of such general election. 

In Compliance with Article 37 of the constitution of the Republic of Liberia, the Presiding Officer of the House of Representatives of the 55th Legislature on Monday, May 26, 2025, through the Chief Clerk informed the National Elections Commission of the vacancy created in the House of Representatives affecting District #5, Nimba County. 

The Proclamation stated that the House of Representatives shall be composed of members elected for a term of six years and the House of Senate shall be composed of members for nine years by the registered voters in each of the legislative constituencies of the counties.

The Presidential Proclamation furthered that a member of both Houses elected in a by-election to fill a vacancy created by death resignation or otherwise, shall be elected to serve only the remainder of the of the unexpired term of the office. Also, members of the House of Representatives and House of Senate shall be eligible for re-election. 

The Proclamation calls on citizens and foreign residents within Nimba County, Electoral District #5 to respect, specifically, this National Holiday, as such.

The Proclamation further directs that all government offices, business houses, private and public institutions of learning and market places in the affected locations be closed on that Day so as to allow residents exercise their democratic franchise from six O’clock ante meridian to six O’clock Post meridian.

 The Proclamation says the National Elections Commission has scheduled the holding of the by-election for a Representative in District #5, Nimba County, on Tuesday, August 12, 2025. 

The Proclamation added that the Government of the Republic of Liberia is desirous of ensuring the unhindered movement of eligible voters, granting unto them the opportunity to exercise their political franchise in District #5, Nimba County, in a peaceful manner on the day of the election.
